随心（Whimsy）由 Cairnova（磐星）提供。当你注册、下载或使用随心，即表示你已阅读、理解并同意本条款以及隐私政策。如果你不同意，请不要使用随心。

Whimsy (随心) is provided by Cairnova. By registering for, downloading or using Whimsy, you confirm that you have read, understood and agreed to these Terms and to our Privacy Policy. If you do not agree, please do not use Whimsy.

随心是一款为大模型时代重新设计的个人收藏与推荐系统：你一键收下内容，整理与重逢交给智能体。其中「问」的对话智能体属于订阅特权；后续推出的云同步等能力也将纳入订阅。

Whimsy is a personal collect-and-rediscover system rebuilt for the age of large models: you save in one tap, and the agent handles sorting and resurfacing. The "问" (Ask) conversational agent requires a subscription; future capabilities such as cloud sync will also be part of it.

你需要用邮箱注册并通过邮箱验证码验证。请妥善保管你的账户凭据；账户下发生的活动由你负责。发现异常请及时联系我们。

你需年满 13 周岁（或你所在地法律规定的更高最低年龄）方可使用随心；未满 18 周岁的用户应在监护人知情并同意后使用。

You register with an email address and verify it via an email code. Keep your account credentials safe; you are responsible for activity under your account. Contact us promptly if you notice anything unusual.

You must be at least 13 years old (or the higher minimum age required where you live) to use Whimsy. Users under 18 should use it with the knowledge and consent of a guardian.

随心的收藏、整理与重逢免费使用；订阅解锁「问」对话智能体，提供按月与按年两种周期，通过 Apple App Store 计费。当期价格以 App 内与 App Store 展示为准。

• 费用在你确认购买时向你的 Apple ID 收取。
• 订阅默认自动续订，除非在当期结束前至少 24 小时关闭。
• 续订、取消与退款均按 Apple 的规则，在你的 Apple ID 账户设置中管理。

价格与套餐可能调整；变更只影响调整后的续订周期。

Saving, sorting and rediscovery are free to use; a subscription unlocks the Ask agent, available monthly or yearly and billed through the Apple App Store. Current prices are those shown in the app and on the App Store.

• Charges are made to your Apple ID when you confirm the purchase.
• Subscriptions renew automatically unless turned off at least 24 hours before the end of the current period.
• Renewal, cancellation and refunds follow Apple's rules and are managed in your Apple ID account settings.

Prices and plans may change; any change applies only to renewal periods after the change.

你保存的内容归你所有。为运行服务，你授予我们一项有限的许可，用于存储、处理你的内容，并为你生成标题、摘要与向量等衍生信息。

若你主动将某张卡设为公开，你同时许可我们在「逛」的发现流中带署名展示该卡。你随时可以把它改回私有。你需对自己收下与公开的内容负责，并确保拥有相应权利。

The content you save belongs to you. To run the service, you grant us a limited licence to store and process your content and to generate derived information such as titles, summaries and vectors.

If you choose to make a card public, you also license us to display it with attribution in the "逛" (Discover) feed. You can switch it back to private at any time. You are responsible for the content you save and make public, and for having the rights to it.

请不要用随心从事违法、侵权或有害的行为。你收下的内容与「问」的输入会经过内容审核；违规内容可能被限制公开或处理。

Do not use Whimsy for unlawful, infringing or harmful activity. Content you save and your Ask inputs pass through content moderation; violating content may be restricted from being public or otherwise actioned.

如果你严重或反复违反本条款——包括从事违法行为、滥用服务、危害他人或系统安全——我们可以暂停或终止你的账户；可行时会提前告知并说明原因。

你也随时可以停止使用，并在应用内「我 → 注销账号」删除账户（注销前可先导出数据）。账户终止后，你的数据按隐私政策处理。

We may suspend or terminate your account if you seriously or repeatedly violate these Terms — including unlawful activity, abuse of the service, or endangering others or the security of our systems. Where practical, we will notify you in advance with reasons.

You may stop using Whimsy at any time and delete your account in-app via Me → Delete Account (you can export your data first). After termination, your data is handled as described in the Privacy Policy.

随心按「现状」与「可用」提供。在法律允许的范围内，我们不对服务作出明示或默示的担保，也不保证服务不中断或完全无误。

Whimsy is provided "as is" and "as available." To the extent permitted by law, we make no express or implied warranties, and do not guarantee that the service will be uninterrupted or entirely error-free.

在法律允许的最大范围内，我们不对间接损失、附带损失、惩罚性损害，或利润、数据、商誉的损失承担责任。

就与服务相关的全部索赔，我们的累计责任总额，以你在索赔发生前 12 个月内实际支付的订阅费用为限；若你未支付过任何费用，则以 10 美元为限。部分司法辖区不允许上述某些限制，届时以法律允许的最大限度适用。

To the maximum extent permitted by law, we are not liable for indirect, incidental, consequential or punitive damages, or for loss of profits, data or goodwill.

Our total aggregate liability for all claims relating to the service is limited to the subscription fees you actually paid in the 12 months before the claim arose — or USD 10 if you have paid nothing. Some jurisdictions do not allow certain of these limits; where so, they apply to the fullest extent permitted.

本条款适用新加坡法律（不含其法律冲突规则）。因本条款或服务产生的争议，双方应先友好协商；协商不成的，提交新加坡有管辖权的法院处理。你所在地法律赋予你的不可放弃的消费者权利，不受本条影响。

These Terms are governed by the laws of Singapore, excluding its conflict-of-law rules. Disputes should first be resolved through good-faith negotiation; failing that, they will be submitted to the courts of competent jurisdiction in Singapore. This does not affect any non-waivable consumer rights under the laws of where you live.

我们可能会不时更新本条款。有实质性变更时，我们会在应用内或本页面标注更新日期。更新后继续使用随心，即表示你接受更新后的条款。

We may update these Terms from time to time. When there are material changes, we will note the updated date in-app or on this page. Continued use of Whimsy after an update means you accept the updated Terms.
